Life Dreamery LLC (“Life Dreamery” or “we”) respects your privacy and is committed to protecting it. This Privacy Policy (“Policy”) is for our individual clients and other users of our public website, www.lifedreamery.com (the “Site” or “Service”). The Policy describes how we may collect, use, and share your Personal Information. It also explains related rights and choices you may have. Rights described in this Policy may not apply if you are interacting with us on behalf of an organization that is our client.

Change In Control Or Merger

6. Children’s Privacy
Our Services are not directed to children under the age of 16. We do not knowingly collect, maintain, or process children’s Personal Information unless the child’s parent or guardian consents and provides the information. If we determine that we have received a child’s Personal Information from a source other than the child’s consenting parent/guardian, we will immediately delete the information.

We don’t share Personal Information with third parties for their direct marketing purposes.

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially reasonable means to protect your Personal Information, we cannot guarantee its absolute security.
12. California Residents
California consumers have certain rights regarding collection, use and sharing of their Personal Information by a “business” as defined in the California Consumer Privacy Act (CCPA). As of February 17, 2021, Life Dreamery does not meet the CCPA’s definition of a “business.” As we grow and expand, we are committed to regularly reviewing applicability of the CCPA and other privacy regulations and will update this Privacy Policy as necessary.
13. Data Subjects In The EEA , United Kingdom and Switzerland
Data Controller
Personal Information that we collect regarding individuals who reside in a member state of the European Economic Area (“EEA”), the United Kingdom or Switzerland is controlled by Life Dreamery, a North Carolina company headquartered in Asheville, North Carolina, U.S.A. Life Dreamery does not maintain an establishment in the EEA, United Kingdom or Switzerland and we do not process special categories of data, as referred to in Article 9(1) of the General Data Protection Regulation (“GDPR”), on a large scale.
Lawful bases for processing
We may process your Personal Information for the purposes described above if at least one of the following grounds for processing applies:
Processing is necessary for us to perform a contract with you or to take steps at your request prior to entering into a contract;
Processing is necessary to comply with our legal obligations;
Processing fulfills our legitimate interests in a manner that does not outweigh your rights and freedoms. Our legitimate interests include: protecting our Services against malicious intrusions and unauthorized use; maintaining and improving our Services; understanding how our Services are used; personalizing our Services; promoting our Services effectively; and complying with legal obligations and protecting our legal rights;
Processing is necessary to protect the vital interests of you or another individual; or

International transfers
Life Dreamery LLC has its headquarters in the United States. Information we collect about you will therefore be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Commission under Article 45 of the GDPR. To the extent we make transfers of personal information to third parties in the United States or other countries that have not received an adequacy finding, we rely on derogations for specific situations as set forth in Article 49 of the GDPR. We do not make any decisions involving the use of algorithms or profiling that significantly affects you.

The right to restrict our processing of your personal information. You have the right to restrict our processing if: (1) you disagree with the accuracy of your information; (2) our processing is deemed unlawful and you do not want us to erase your information; or (3) we no longer need your information for the purposes for which we collected it but we must store it to comply with our legal obligations.
The right to data portability. You may receive and transmit your personal information to another controller where our processing is based on consent you gave us and was carried out by automated means.

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Life Dreamery LLC (“we,” “us” or “our”), concerning your access to and use of the www.lifedreamery.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. IF YOU DO NOT REJECT IT, THIS SECTION WILL APPLY, AND MOST DISPUTES BETWEEN YOU AND US WILL BE SUBJECT TO INDIVIDUAL ARBITRATION. THIS MEANS THAT: (1) NEITHER A COURT NOR A JURY WILL RESOLVE ANY SUCH DISPUTE; (2) YOU WILL NOT BE ABLE TO PARTICIPATE IN A CLASS ACTION OR SIMILAR PROCEEDING; (3) LESS INFORMATION WILL BE AVAILABLE IN DISCOVERY; AND (4) APPEAL RIGHTS WILL BE LIMITED.
If a dispute arises between you and us, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and the Company agree that you and we will resolve any claim or controversy at law or equity that arises out of these Terms, the Website, or our products or services (a “Claim”) in accordance with one of the subsections below:
(i) If either you or we make a demand for arbitration, you and we must arbitrate any dispute or claim between you or any person who uses your Account, and us, our affiliates, and/or agents, if it relates to your Account, your use of the Website, or to these Terms, except as noted hereafter.
(ii) Either party may assert an individual case in small claims court or your state’s equivalent court. Nothing in this Section shall limit either party from seeking injunctive or other exigent relief from a court of law.
Notwithstanding any other language in this Section, only a court, not an arbitrator, will decide disputes about the validity, enforceability, coverage or scope of this Section of these Terms. However, any dispute or argument that concerns the validity or enforceability of these Terms as a whole is for the arbitrator, not a court, to decide. Further, you and we may litigate in court to compel arbitration, stay proceedings pending arbitration, or confirm, modify, vacate or enter judgment on the award entered by the arbitrator.
